Terms of Service

1. Overview

These Terms of Service govern your participation in contests operated through Punchy, a platform by Digital Catalyst LLC ("we," "us," or "our"). By submitting an entry, you agree to these terms.

No purchase necessary. A purchase does not improve your chances of winning.

2. Eligibility

Contests are open to legal residents who are 18 years of age or older at the time of entry. Employees of Digital Catalyst LLC and their immediate family members are not eligible.

3. How to Enter

Submit your entry through the Punchy platform by uploading eligible video content and providing your name and phone number. Only one entry per person unless otherwise specified. Entries must be submitted before any stated contest deadline.

4. Video Requirements

• Videos must be original content created by you.
• Minimum resolution of 720p.
• Must not contain unlicensed copyrighted music, offensive, or illegal content.
• By submitting, you confirm you have the right to submit the content.

5. Prize

The prize for each contest is stated on the contest page (e.g., $500). Prizes are non-transferable and have no cash equivalent unless specified. Digital Catalyst LLC reserves the right to substitute a prize of equal or greater value.

6. Winner Selection

Winners are selected by Digital Catalyst LLC at our discretion based on contest criteria. The winner will be notified via SMS and/or the contact information provided. If a winner cannot be reached within 7 days, an alternate winner may be selected.

7. Ownership of Submitted Content

By submitting a video, you irrevocably assign and transfer to Digital Catalyst LLC all rights, title, and interest in and to the submitted content, including all intellectual property rights worldwide. Digital Catalyst LLC may use, reproduce, modify, distribute, display, and create derivative works from your submission for any purpose, without further consent or compensation.

You represent that the submitted content is your original work, that you have the right to make this assignment, and that it does not infringe any third-party rights.

8. SMS Consent

By providing your phone number, you consent to receive SMS messages from Punchy / Digital Catalyst LLC regarding contest updates and results. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.

9. Limitation of Liability

Digital Catalyst LLC is not responsible for technical failures, lost entries, or any damages arising from contest participation. We reserve the right to cancel or modify a contest at any time.
